Vouch AI is NOT a licensed medical device, clinical monitoring tool, or substitute for professional medical advice, diagnosis, treatment, or clinical supervision. Never disregard professional medical advice or delay seeking care because of information provided by Vouch AI.
2. NO GUARANTEE OF SMS ALERT OR ALARM DELIVERY: Medication alarms and automated SMS text alerts rely on external factors beyond our control, including cellular network coverage, carrier spam filtering, recipient phone status, device battery level, Do Not Disturb operating system rules, and background execution limits. Vouch AI DOES NOT GUARANTEE THAT ALARMS OR SMS TEXT ALERTS WILL BE DELIVERED ON TIME, ACCURATELY, OR AT ALL. You and your designated family contacts remain solely responsible for managing and verifying medication schedules.
1. Acceptance of Terms & Eligibility
By downloading, installing, accessing, or using the Vouch AI mobile application or website, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all terms, you may not use Vouch AI.
Eligibility: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account, enter family contact details, or purchase a subscription.
2. Family & Third-Party Contact Clause (TCPA Compliance)
Vouch AI allows you to input the name and cellular phone number of a trusted family member or caregiver to receive automated emergency SMS escalation texts. By entering any third-party phone number into Vouch AI, you explicitly represent and warrant that:
- You have obtained explicit permission and consent from the contact person to share their phone number with Vouch AI.
- The contact person has consented to receiving automated SMS text messages triggered by unconfirmed medication alarms.
- You will activate the Caregiver SMS Consent toggle in-app before saving their contact entry.
- You will immediately remove any contact who requests to be removed or revokes consent.
3. Subscription Billing, 3-Day Free Trial & Cancellations
Vouch AI provides auto-renewable subscription plans managed through Apple ID App Store billing and RevenueCat:
- Subscription Pricing: $9.99 per month (Monthly Plan) or $99.99 per year (Annual Plan, save 16%). Prices are displayed in local currency on the App Store paywall.
- 3-Day Free Trial Conversion: New subscriptions include a 3-day free trial period. If you do not cancel at least 24 hours prior to the expiration of the 3-day trial, your Apple ID account will automatically be charged for the chosen subscription plan.
- Auto-Renewal & Cancellation: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions anytime in your iOS Settings > Apple ID > Subscriptions.
- Restoring Purchases: You can restore active purchases on new iOS devices via the "Restore Purchases" button in the app.
- Apple Subscription Terms: All billing and refunds are governed directly by Apple's Standard EULA & Media Services Terms.
4. User Account Responsibilities & Acceptable Use
You are responsible for maintaining the confidentiality of your device access and for all activities under your account. You agree NOT to:
- Enter invalid, fraudulent, or unconsented phone numbers for emergency contacts.
- Use Vouch AI for emergency medical dispatch, 911 calls, or life-support critical telemetry.
- Reverse engineer, decompile, or attempt to extract the source code of the application binary.
- Transmit spam, malicious code, or automated alert flooding.
5. Intellectual Property Rights
All visual designs, logos, software binaries, source code, visual artwork, slogans, and trademarks (including "Vouch AI", "Never Miss a Dose. Never Worry Alone.") are the exclusive intellectual property of Vouch AI Inc. Unauthorized copy, modification, or distribution is strictly prohibited.
6. Disclaimer of Warranties ("AS IS")
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOUCH AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Strong Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VOUCH AI INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF HEALTH, PERSONAL INJURY, OR MEDICAL COMPLICATIONS ARISING OUT OF OR IN CONNECTION WITH MISSED MEDICATION DOSES, FAILED SMS ALERTS, DELAYED NOTIFICATIONS, TELECOM NETWORK OUTAGES, OR APP UNAVAILABILITY.
Indemnification: You agree to defend, indemnify, and hold harmless Vouch AI Inc. from any claims, damages, liabilities, or expenses (including legal fees) arising from your breach of these Terms or failure to obtain third-party SMS consent.
8. Apple Required Minimum EULA Terms
In accordance with Apple App Store Review Guidelines, the following additional terms apply:
- Acknowledgement: You and Vouch AI Inc. acknowledge that these Terms are concluded between You and Vouch AI Inc. only, and not with Apple Inc. Vouch AI Inc. is solely responsible for the licensed application and content thereof.
- Maintenance & Support: Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.
- Warranty & Product Claims: In the event of any failure to conform to applicable warranty, Apple's sole obligation is to refund the purchase price. Apple is not responsible for addressing any claims relating to the app, including product liability or regulatory compliance.
- Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
9. Governing Law & Contact Information
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in courts of competent jurisdiction.
